Our Residential Real Estate Department is experienced in assisting clients throughout Fairfield and Westchester Counties and New York City in their residential real estate transactions, from the first-time home purchaser to the sophisticated developer. We assist clients in the mortgaging and refinancing of their properties and are approved closing counsel for many lenders, including being the primary Connecticut counsel for mortgage closings for three of the Northeast’s major banks. We regularly advise our clients regarding any construction, zoning, environmental, land use, and title issues that may arise.   • Estimated Title Insurance Premium – $3,190
  • Estimated Title Search Fee – $600

Town of Greenwich Taxes are due on July 1 and January 1 of each year. The adjustment (usually in favor of the Seller) is calculated on a per diem basis and is adjusted from the day of closing through either December 31 or June 30, depending on the closing date.

Recording fees are $53.00 for the first page and $5.00 for each additional page of any document (i.e., Warranty Deed, Mortgage Deed) being recorded.

Fuel oil, propane gas – credit to Seller.

Estimated Bank Fees:

  • Prepaid interest based on the amount of mortgage and interest rate and calculated from the day of closing through the end of the month.
  • Tax escrow based on the monthly amount of real estate taxes (if required by lender).
  • Hazard insurance escrow based on the monthly amount of homeowner’s insurance (if required by lender).
  • Homeowner’s insurance premium for one year.
  • Processing fee – $500
  • Appraisal fee – $500 (per appraisal)
  • Credit Report – $30
  • Flood Certification – $30
  • Tax service fee – $85
  • Bank fee – $500

In many cases, buyers and sellers tend to focus on the dollar amount offered, but our attorneys know how important it is to look beyond the sale price. A formal offer is also likely to include many other clauses, expectations, incentives, and other concerns that you must consider.

As closing approaches, our firm will prepare and compile all of the required paperwork and documents, including the deed to the property, transfer declarations, and the bill of sale. We will also handle all title-related issues and address any encumbrances that might exist. Finally, we will put everything together in a closing statement so that all of the closing costs are made clear.

The last step of the selling process is the closing. Title Considerations

Connecticut Closing Attorneys

A residential real estate transaction is not complete until closing. Prior to closing, the deed and other documents must be prepared. At the closing, a closing statement is made available to both the buyer and seller indicating the costs that each party is covering. The title transfers to the buyer from the seller, and the buyer provides full payment—usually with money secured by a mortgage. It is important for each party to have a lawyer present to ensure that everyone understands the terms of the sale and that all of the documents are signed and executed properly. An attorney can also help to address any last-minute questions or disputes that may arise.

Tax Certiorari Counsel in Westchester County

Taxes are an unavoidable part of life in the United States, and most cities, towns, and villages in New York and Connecticut rely heavily on property taxes as a primary revenue source to fund municipal budgets and public schools. As the residential and commercial real estate markets grew in the early 2000s, property values increased quickly, as did the associated property taxes. However, when the market growth slowed and property values started to decrease, property tax obligations did not decrease in the same manner for many property owners.

The process through which a property owner can appeal his or her municipal tax obligation is called “tax certiorari” or “tax cert.” A tax cert generally begins with a grievance filed with the municipality that assessed the tax. Each municipality may have its own rules and deadlines for filing a grievance, so it is important to work with an attorney who is familiar with your community. From there, you have the right to request a review before the local tax appeal board. If your review is not successful, you can file a judicial tax appeal and take your matter to court.

  • Adverse possession — to establish, defend, or dispute rights of ownership acquired by twenty years of exclusive, open, notorious, non-permissive use, including in rural, suburban, and urban areas.
  • Title disputes and discrepancies — to clarify and resolve complex title issues that can impair real estate transactions or development. Using due diligence, we initiate or defend quiet title and try title actions, filing suit to have the court definitively resolve title disputes in our clients’ favor and extinguish missing interests or other encumbrances.
  • Partition actions — handling actions to divide property or compel buyouts when joint owners cannot agree on how to use the property.
  • Right-of-way disputes and boundary disputes — fighting for the interests of homeowners and other landowners in dispute with adjacent owners over boundaries and property use: lot line disputes, intruding fences, encroaching structures, setback encroachments, and obstructed views.
  • Nuisance and trespass litigation — helping landowners enjoy their property free from unlawful intrusion by others, including unwanted travel and passage over land, illegal removal of trees, vegetation, and soil from property, and unlawful discharge of water or other substances onto land.

Mandelbaum Barrett PC's Real Estate Team Completes Largest Real Estate Transaction in the Firm's 89 Year History

Congratulations to Mandelbaum Barrett PC's Real Estate team on completing the largest real estate transaction in the Firm's 89 year history. This complicated transaction on behalf of long-time Firm client Rubenstein Properties involved the sale of a portfolio of 29 properties (located in 6 different states) having approximately 5.2 M square feet of industrial space with a purchase price of nearly $200M. Member Owen Hughes led a team of attorneys and support personnel from the real estate practice and our Environmental Group, including Member Gordon Duus, who provided assistance on environmental matters. The contract was negotiated and signed in the fall of 2018. The transaction involved complex title and survey issues, property condition diligence, tenant issues, bulk sale and environmental compliance activities and negotiation and procurement of environmental insurance. The closing stretched over 3 days during the week of January 14, 2019, including one night with Owen and Chair Barry Mandelbaum leaving the closing table at midnight. We are proud of the team effort by the members of our Real Estate and Environmental practices to ensure a successful portfolio sale for our client.
