Mandelbaum Barrett PC’s Banking and Financial Services attorneys combine depth and experience in the commercial, industrial and asset-based lending space.
Mandelbaum Barrett PC’s Banking and Financial Services Practice Group has a strong footprint in commercial and industrial and asset-based lending, as well as trade finance, mortgage warehousing and other secured, unsecured, domestic and cross border debt products. On a regular basis we represent financial institutions (agent banks, bank groups and individual commercial lenders), finance companies, venture capital funds and borrowing entities.
Our key to a successful transaction is to foster candor, accuracy and confidence in the relationship from its inception.
Regardless of the particular undertaking involved, we work closely with each and every client, as well as the other parties, so that we can best understand their goals, expectations and approach to the transaction. We offer seasoned advice regarding the proposed transaction and assist in tailoring the structure to best meet those expectations on a legal, risk and practical level.
We regularly collaborate with the Firm’s Bankruptcy and Creditor Rights Practice Group during pre-closing diligence to consider, evaluate and provide for the possibility of a bankruptcy or other insolvency proceeding after the closing. We also offer years of experience in debtor-in-possession financings, as well as structuring and implementing secured creditor sales, assignments for the benefit of creditors and exit financing.
Depth and experience advising single and syndicated lenders engaged in mortgage warehousing, equipment financing, trade and supply chain finance, including domestic and international factoring, receivables purchase financing, purchase order funding and documentary and standby letters of credit allows us to collaborate with our clients on deal structure, and assist in negotiating intercreditor agreements, subordination agreements and other third-party agreements.
We have expanded Banking and Financial Services to incorporate Cannabis lending. Navigating the complexities of cannabis banking compliance requires a meticulous understanding of both financial regulations and the evolving landscape of cannabis legislation. In light of this, Mandelbaum Barrett PC recognizes the unique challenges imposed on financial institutions seeking to provide services to cannabis-related businesses while adhering to federal and state guidelines. The Firm is dedicated to aiding banks and financial institutions in implementing effective KYC/AML protocols and navigating the intricate demands outlined by the Financial Crimes Enforcement Network and the Controlled Substances Act. We work with our clients to ensure they can confidently navigate these regulatory requirements with integrity, enabling them to enter the new and dynamic cannabis sector.
