Untying the Vows: “So, I married a Helicopter Parent…”

This “helicopter parenting” behavior often includes checking in on every meal, monitoring small health concerns, or criticizing routine tasks like diaper changes. For many, it can feel like their parenting is constantly being watched, even during their own scheduled parenting time.

Holiday Season Engagements: What You Need to Know About the Rules of Engagement Rings

December 20, 2024

In New Jersey, engagement rings are treated as conditional gifts. If the engagement is called off, the ring must be returned to the giver because the condition—marriage—was not fulfilled. While New Jersey courts generally focus on the conditional nature of the gift, fault can sometimes be considered when determining who keeps the ring. For example, if the giver’s actions directly caused the engagement to end, they may forfeit their right to reclaim the ring (NJ Law Journal). Proving intent beyond a ring being a gift conditioned on the marriage taking place can be challenging.

Who gets custody? Shared Parenting continues to attract attention nationally

February 10, 2022

The Washington Post Magazine recently featured a story spotlighting 50/50 shared parenting in custody cases. This topic continues to garner attention on both the state and national levels. The Family Law Department here at Mandelbaum Barrett PC is well-versed in this arena, having just published an analysis on the issue in the New Jersey Law Journal. Read that article here. At present, there is no presumption or automatic consideration of 50/50 shared parenting time in the State of New Jersey. Two bills, however, remain pending with the legislature on these issues. Modern attitudes towards working parents and dual working-parent households, as well as psychological studies, appear to be fueling trends.
