Litigation partner Lawrence C. Weiner secured a notable summary judgment win for our real estate brokerage client in a high-value commission dispute. Relying on the precedent set in Pagano v. 48 South Franklin, the court found that the building’s purchaser had “affirmatively assumed” the obligation to honor the commission agreement with the prior owner.

The court awarded over $323,000 in commissions due and also confirmed that attorneys’ fees and default interest may now be pursued under the agreement.
