Favorable Pre-Trial Settlement Achieved for NYC Medical Professional

Our firm recently secured a favorable settlement on behalf of a medical practitioner in a complex commercial litigation matter in the Commercial Division of the New York Supreme Court. The case involved high-stakes claims totaling over $4 million in alleged damages related to breach of contract and the faithless servant doctrine—a legal principle that permits an employer to recover compensation paid to an employee who acted disloyally.

Background: Breach of Contract and Faithless Servant Doctrine

The plaintiff alleged that our client, a physician practicing across New York City, had violated the terms of his employment contract and breached his duty of loyalty, invoking the faithless servant doctrine to seek substantial financial recovery. These claims, if successful, could have had significant professional and financial implications for our client.

Strategic Defense and Litigation Success

We began our defense by defeating the initial order to show cause—a request for immediate judicial intervention—and later successfully expanding the scope of trial to include patient witnesses and overcoming a motion for summary judgment, ensuring that the case would in fact proceed to trial. In advance of the six-week jury trial, we effectively filed and argued a series of pre-trial motions in limine, which are used to exclude certain evidence from being introduced at trial, leading a host of favorable rulings that substantially disrupted and upset the plaintiff’s intended trial strategy.

Thanks to the favorable rulings on our pre-trial motions, we were able to leverage our legal position to negotiate an incredibly favorable settlement for our client before the trial commenced. This result ensured a substantial limitation on our client’s potential liability while also saving the client the time, expense, and risk of trial.
