We wanted to share a recent healthcare litigation result that may be of interest, particularly for clients operating in highly regulated industries or interacting with state agencies.
Our healthcare litigation team recently secured emergency relief on behalf of a hospital system client in a dispute with a State agency. The matter arose after the client temporarily suspended operations at one of its facilities and, under pressure from regulators, submitted an application that would have resulted in the loss of its certificate of need and hospital license.
When it became clear that the agency intended to move forward with the application process despite the client’s formal request to withdraw it, our team acted quickly to protect the client’s interests. Within a compressed timeframe, we filed for injunctive relief to prevent a scheduled public hearing that would have advanced the process and caused irreparable harm to our client.
The court granted temporary restraints, enjoining the agency from proceeding with the hearing. This halted the hearing and preserved the client’s ability to maintain its regulatory approvals and associated rights while the matter is litigated.
This result is significant because it underscores a few important points for organizations navigating regulatory oversight:
