Franck, and Grant Petrosyan obtained a significant pre-answer dismissal of a complaint in a New Jersey State Court Action filed against a medical practice and its shareholder-physician. The litigation was filed by a corporation seeking to hold the medical practice liable under claims of breach of contract, unjust enrichment, quantum meruit and account stated. The plaintiff even tried to hold the shareholder-physician personally liable by attempting to pierce the corporate veil. The Mandelbaum Team was able to analyze the claims quickly and obtain a dismissal—of the entire litigation—based upon unique legal theories argued by the Mandelbaum Team.
