Our litigation team secured a decisive win for a client in a cannabis-related dispute filed in the United States District Court for the District of New Jersey. Led by partners Joshua S. Bauchner and Todd M. Nosher, the team first successfully transferred the case from Vermont before moving to dismiss claims brought by an attorney who alleged he received a membership interest in cannabis licensees in exchange for legal services; a putative violation of New Jersey’s cannabis regulations. The Court agreed, finding the claims legally insufficient and dismissing the action in its entirety.
This decision reinforces the strict regulatory framework governing ownership interests in cannabis businesses and highlights the risks of non-compliant arrangements, particularly for professionals and operators navigating this evolving industry.
