The Chair of our Intellectual Property group, Joel MacMull, successfully beat a back a motion to dismiss plaintiff’s claim for a violation of the Computer Fraud and Abuse Act claim last week in the United States District Court, District of New Jersey. Joel argued, successfully, that the defendants’ alleged destruction of our client’s data and the resulting impairment to the availability of data was sufficient “damage” under the Act to merit survival of the claim.
