For a California winery facing a $1.3 million trademark infringement judgment, a successful appeal changed the course of a years-long legal battle. The opposing party has since filed a petition with the Supreme Court.
Mandelbaum Barrett PC Intellectual Property & Brand Management Chair Joel G. MacMull was recently featured in Law360, commenting on an ongoing trademark dispute involving Italian winery Cesari SRL and California-based Peju Province Winery LP.
Representing Peju, Joel is involved in a significant appellate matter in which the U.S. Court of Appeals for the Second Circuit vacated a $1.3 million trademark infringement judgment against his client.
Cesari has since filed a petition with the U.S. Supreme Court seeking review of the Second Circuit’s decision, raising questions about the binding effect of Trademark Trial and Appeal Board decisions in federal trademark infringement litigation.
In his comments to Law360, Joel discussed the Second Circuit’s application of Supreme Court precedent and provided insight into the legal considerations surrounding the appellate court’s decision.
The case highlights important considerations for businesses navigating trademark disputes, particularly when prior administrative decisions intersect with federal litigation.
