Steven Adler, Co-Chair of the Litigation, Employment Law and Healthcare Litigation Practice Groups at Mandelbaum Barrett PC, recently shared insights on restrictive covenants and how courts balance employer protections with employee rights. Steve discusses a high stakes case from his recent 16-day trial where a medical practice sought to enforce a restrictive covenant against a physician and claim $4.5 million in damages. The court ultimately sided with our client, refusing to enforce the restriction and allowing him to continue practicing in his highly specialized field.
As Steve explains, these cases are “very fact-specific,” often hinging on whether restrictions impose an undue burden on employees — especially in fields like healthcare where public interest and patient care are at stake.
