New Jersey has launched a temporary regulated market for intoxicating hemp-derived beverages (IHBs), creating a limited window of opportunity for alcohol distributors, liquor retailers, and cannabis businesses to participate in this market.
On January 12, 2026, Governor Phil Murphy signed P.L.2025, c.215, establishing a regulatory framework for intoxicating hemp-derived products and replacing prior legislation. Oversight is split between the New Jersey Division of Alcoholic Beverage Control (NJ ABC) and the New Jersey Cannabis Regulatory Commission (NJ CRC).
Starting April 13, 2026, intoxicating hemp beverages may be sold by plenary wholesale or retail license holders and Class 5 cannabis retailers, provided the products:
- Contain ≤5 mg THC per serving and ≤10 mg per container
- Are tested by an accredited lab (ISO 17025, DEA registered)
- Are registered with the NJ ABC before distribution
Products exceeding 0.3% THC in the plant or 0.4 mg THC per container will be legally designated as cannabis, requiring Class 1 or Class 2 cannabis licenses for production and distribution after April 13, 2026.
The temporary alcohol channel closes November 13, 2026. After that date, intoxicating hemp beverages exceeding 0.4 mg THC per container can only be sold through licensed cannabis retailers.
