Mandelbaum Barrett attorneys Arla Cahill, Joel MacMull, and Ryan Buehler scored a big victory this week. In a trade secrets matter the three are involved in, the United States District Court, District of New Jersey granted their motion to amend the Complaint to add a proper defendant more than three years after the case was filed. The defendants objected on grounds that Mandelbaum’s motion was untimely, that they would be unduly prejudiced by any amendment and that the contemplated amendments were futile. United States Magistrate Judge Matthew Skahill disposed of each of these arguments as unavailing. More specifically, he observed that Mandelbaum had acted in a timely manner to ascertain the identity of the proper defendant in the face of conflicting evidence and that justice would not be served by precluding the firm’s client from amending its Complaint.
