Anthony J. Iacullo, Criminal Defense Partner at Mandelbaum Barrett PC, successfully obtained the dismissal of theft and official misconduct charges against Hardyston Police Officer Konstantinos Protogeropoulos, as reported by NJ.com.

The officer faced allegations stemming from a September 2023 incident in which a man claimed a white gold diamond ring went missing after being arrested for driving while intoxicated. Following the accusation, Protogeropoulos was suspended without pay, and the case underwent two grand jury proceedings. An initial grand jury in November 2023 returned a “no-bill,” declining to indict the officer, but a subsequent presentation in February 2024 led to an indictment.

On January 8, 2025, Sussex County Superior Court Judge Michael C. Gaus granted Iacullo’s motion to dismiss the indictment, citing insufficient evidence. NJ.com reported that the judge’s 40-page decision highlighted key facts, including testimony from witnesses who observed Protogeropoulos wearing a ring similar to the one in question prior to the arrest.

“This decision allows Officer Protogeropoulos to begin moving forward after a challenging period,” Iacullo commented.

The charges were dismissed without prejudice, meaning they could potentially be refiled, but the ruling marks a critical step in restoring the officer’s reputation. As reported by NJ.com, the Sussex County Prosecutor’s Office has not yet announced its next steps regarding the case.
