David B. Bailen

David B. Bailen is as an Associate in the Healthcare and Life Sciences Practice Groups at Mandelbaum Barrett PC where he specializes in representing clients in transactional matters, such as mergers and acquisitions and contract negotiations, along with regulatory compliance issues, ensuring transactions adhere to relevant state and federal laws. He provides ongoing counsel on compliance with HIPAA, state privacy laws, the Anti-Kickback Statute, FDA regulations, 42 CFR Part 2, and a variety of other legal frameworks. Additionally, he advises clients on labor and employment matters.

His client roster includes a diverse range of entities, such as health systems, medical practices, physical therapy providers, long-term care and assisted living facilities, pharmacies, pharmaceutical companies, research centers, multidisciplinary practices, and numerous vendors in the technology and healthcare sectors. He also represents professionals—physicians, chiropractors, pharmacists, veterinarians, and physical therapists—in contract negotiations and licensing matters involving bodies such as the Board of Medical Examiners.

Mr. Bailen is committed to staying ahead of the evolving landscape in technology and healthcare. He holds the Certified Information Privacy Professional (CIPP/US) designation from the International Association of Privacy Professionals, which reflects his dedication to providing efficient and innovative solutions that meet the needs of his clients today while preparing them for the future.

Mr. Bailen graduated from the State University of New York at Oneonta in May 2014 with a B.S. in History and from the West Virginia University College of Law in May 2018.  He is admitted to practice in New Jersey and Ohio.

Outside of his professional commitments, Mr. Bailen is an active volunteer. He serves as Co-Chair of the Jewish Bar Association of New Jersey’s College Outreach and Advocacy Sub-Committee, is a Committee Member of the Commerce and Industry Association of New Jersey’s Healthcare Steering Committee and is an Associate Board Member of a local non-profit organization in Morristown.
