COVID-19 OTC TEST KITS
The Healthcare Department at Mandelbaum Barrett PC successfully represented a physician practice group that participated in the Biden Harris Over the Counter Test Kit Demonstration (the “Program”) in terminating the suspension of their payments by the Centers for Medicare & Medicaid Services (“CMS”) on the basis of credible allegations of fraud. Following a financial hardship appeal, CMS directed its contractor, Safeguard Services, to terminate the payment suspension and release all escrowed funds to the practice.
REINSTATEMENT OF SANCTIONED PHARMACIST’S MEDICAID ENROLLMENT
The Healthcare Department at Mandelbaum Barrett PC successfully represented a NY and NJ licensed pharmacist in a petition for reinstatement to the New Jersey Medicaid program, after a debarment that lasted 12 years, based upon a conviction of one count of Third Degree Medicaid fraud. The pharmacist had previously been excluded from the Medicare program, disqualified from the Medicaid program and disciplined by both the New York and New Jersey state pharmacy boards. In the petition to the New Jersey Medicaid program, the Healthcare Department established the pharmacist’s complete rehabilitation and fitness for reinstatement into the program.
