Divorce and the Child With Special Needs: Be Aware of Child Support Payments

Depending on which statistics you believe, between 40 and 50 percent of first marriages will end in divorce or permanent separation, and second marriages fare even worse. While there is no such thing as a "typical" divorce, a divorcing couple that has a child with special needs faces an even more complicated series of decisions and choices than most. Family law attorneys, often well trained in the complicated and emotionally charged world of divorce settlement, may not have all of the answers for the divorcing parents of a child with special needs. In these cases, it is important to meet with a special needs planner to discuss options for your child. One important consideration is the impact child support payments will have on the child's eligibility for Supplemental Security Income (SSI).
Who gets custody? Shared Parenting continues to attract attention nationally

The Washington Post Magazine recently featured a story spotlighting 50/50 shared parenting in custody cases. This topic continues to garner attention on both the state and national levels. The Family Law Department here at Mandelbaum Barrett PC is well-versed in this arena, having just published an analysis on the issue in the New Jersey Law Journal. Read that article here.
At present, there is no presumption or automatic consideration of 50/50 shared parenting time in the State of New Jersey. Two bills, however, remain pending with the legislature on these issues. Bills have been proposed in 39 of 50 states requiring that judges either consider shared custody or abide by a presumption of shared custody. Modern attitudes towards working parents and dual working-parent households, as well as psychological studies, appear to be fueling trends.

More than listening, parties need to obtain the benefit of the bargain reached in a divorce resolution. Sometimes, divorcing or divorced people feel overwhelmed when their spouse or former spouse fail to comply with court orders. They had reached a bargain, but suddenly they are no longer reaping its benefit. When this happens, it may be necessary to formally apply to the court for enforcement if letters or more informal requests don't work. Wronged parties then end up incurring counsel fees to simply try and get the benefit of their original agreement.

I read the January 30, 2022 CNN article, "How COVID is Making Divorce Cases More Complicated." The current difficulties arising in divorce and post-divorce cases go far beyond masks and vaccines. COVID impacts the resolution of cases. In our current environment, it is harder to obtain a meeting of the minds and achieve a fair resolution. The world lacks definitive answers to COVID questions and creates a more difficult environment. This time of uncertainty is coupled with greater anxiety, heightened frustration, and a lack of patience in everything and particularly with regard to endeavoring to resolve divorce cases.
