Mandelbaum Barrett PC attorneys Joseph Peters and Ethan Wells recently secured a significant victory in a complex insurance coverage dispute stemming from a golf cart accident.
Our client was riding in the back seat of a golf cart when she was violently thrown from the vehicle after the driver executed a high-speed U-turn. Although the driver was determined to be negligent, his homeowner’s insurance carrier denied coverage, relying on a purported policy exclusion.
For more than three years, the parties engaged in extensive litigation, including competing dispositive motions on the scope and applicability of the policy language. At oral argument, a New Jersey state court judge rejected the carrier’s position, finding that the tortfeasor’s homeowner’s policy did provide coverage for the incident. As a result, our client now has access to the policy’s $500,000 limits.
This ruling reinforces the importance of challenging improper coverage denials and demonstrates our team’s ability to navigate complex insurance disputes to secure meaningful results for injured clients.
