On February 18, 2025, attorney Joshua S. Bauchner, Chair of the Cannabis, Hemp, and Psychedelics Practice at Mandelbaum Barrett PC, appeared on ONNJ Mornings with Ken Rosato to discuss a major legislative proposal that could reshape New Jersey’s cannabis industry. The bill aims to streamline the transition of medical dispensaries into the recreational market by eliminating the need for additional municipal approvals, a move designed to counter local resistance and expand legal access to cannabis.

New Jersey’s cannabis industry may soon see a major shift. A new bill, led by Senate President Nicholas Scutari, aims to allow medical dispensaries to transition into recreational sales without additional municipal approval. This move is designed to counter local resistance and streamline access to legal cannabis.

Bauchner emphasized that dispensaries are already located in designated “Green Zones,” ensuring they remain away from schools, churches, and sensitive areas. He also highlighted the shift in public perception, noting that cannabis serves as a safer alternative to opioids for chronic pain and stress relief.

Municipalities that allow dispensaries benefit from a 2% local tax, providing financial incentives. While legal challenges may arise, the push toward normalization continues. Rosato, once skeptical, acknowledged that education has changed his view, encouraging open-mindedness toward cannabis reform.

With increasing public support and financial benefits, the bill could mark a major step in expanding New Jersey’s regulated cannabis market.
